SDM in Bihar: Powers, Responsibilities and Administrative Work
An in-depth analysis of the statutory powers, administrative jurisdiction, and executive authority exercised by an SDM within the Bihar state administrative architecture.
1. The Bihar Sub-Divisional Administrative Setup
Bihar is divided into 9 Administrative Divisions, 38 Districts, and 101 Sub-Divisions. The Sub-Division serves as the foundational unit for decentralised executive administration, ensuring that state government authority is accessible to rural and peri-urban populations without requiring travel to district headquarters.
2. Statutory Magisterial Powers (CrPC / BNSS)
Under the Indian legal framework, the SDM is invested with extensive executive magisterial powers:
• Emergency Crowd Dispersal: Authority to order the use of force or tear gas to disperse unlawful assemblies.
• Inquest Inquiries: Conducting magisterial inquiries into custodial deaths, dowry deaths, and police firings.
• Nuisance Removal: Ordering the removal of public hazards, illegal encroachments, or toxic discharges under Section 133 CrPC.
3. Revenue & Land Regulatory Authority
In Bihar, the SDM exercises appellate jurisdiction over orders passed by Circle Officers (COs) and Land Reforms Deputy Collectors (DCLRs) concerning land mutation, agricultural land ceiling, and settlement of government lands.
4. Protocol & Crisis Management Leadership
The SDM acts as the primary protocol officer during visits of the Chief Minister, Cabinet Ministers, and constitutional dignitaries within the sub-division. During communal tensions or natural catastrophes (drought/floods), the SDM operates as the on-ground crisis commander.
5. Inter-Departmental Coordination Dynamics
Unlike single-department officers, the SDM possesses horizontal supervisory authority across multiple line departments: Public Works (RWD/RCD), Health, Education, Police, and Food & Civil Supplies, ensuring cohesive district governance.
